How to Opt-Out

To stop receiving text messages from a specific That's Right Bitches brand text messaging program, text STOP to the ten digit short code for the text messaging program from which you no longer wish to receive message (i.e., the number from which its text messages are being sent). You will then receive confirmation of your opt-out of that text messaging program. This will only opt you out of the specific text messaging program associated with that phone number. You will remain opted in to other That's Right Bitches, LLC text messaging programs.

Your Mobile Telephone Number

You represent that you are the account holder for the mobile telephone number(s) that you provide. You are responsible for notifying That's Right Bitches brands immediately if you change your mobile telephone number. You may notify That's Right Bitches brands of a number change by changing the number on your profile for the website associated with the specific text messaging program you opted into.

You agree to indemnify That's Right Bitches brands in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify That's Right Bitches, LLC if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.

Bitches, @TRB, #TRB, and/or other That's Right Bitches, LLC brand profile tags or hashtags, you grant to That's Right Bitches, LLC and its third-party service providers who provide content management services (collectively, the “Licensed Parties”) the perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable right to use your That's Right Bitches, LLC-tagged User Generated Content in any manner to be determined in That's Right Bitches, LLC sole discretion, including but not limited to on its webpages, social media pages operated by That's Right Bitches and it partners, and in its other marketing, promotional and advertising initiatives, in any media now or hereafter known.

 

That's Right Bitches may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your User Generated Content in any manner in its sole discretion, with no obligation to you whatsoever.

 

You grant the Licensed Parties the right to use your username, real name, image, likeness, caption, location, or other identifying information in connection with any use of your User Generated Content. Mindful of the high cost of legal disputes, not only in dollars but also in time and energy, both you and That's Right Bitches, LLC. and its subsidiaries including That's Right Now (together, “That's Right Bitches”) agree that any controversy, claim, action, or dispute in any way related to your use of any That's Right Bitches, LLC website, any purchase from ThatsRightBitches.com ThatsRightNow.com, or to any products or services sold or distributed by That's Right Bitches, LLC (“Dispute”) will be resolved by this dispute resolution procedure and arbitration agreement (“Arbitration Agreement”).

Informal Dispute Resolution

Scope of Arbitration Agreement

To the extent you cannot resolve any Dispute through the informal dispute resolution procedure described above, a Dispute shall be resolved through binding individual arbitration. Right to Bring Small Claims in Court

Instead of arbitration, either you or That's Right Bitches, LLC may bring any individual claim in small claims court consistent with the jurisdictional and dollar limits that may apply, as long as it is brought and maintained as an individual claim. All small claims actions must be filed in Los Angeles County, California.

How Arbitration Works

Either party may initiate arbitration, which shall be conducted by the American Arbitration Association (“AAA”) pursuant to its Consumer Arbitration Rules (“AAA Rules”), as modified by this Arbitration Agreement. The AAA Rules are available on the AAA’s website www.adr.org, or by calling the AAA at (888) 855-9575. In the event the AAA is unavailable or unwilling to hear the Dispute, the parties shall agree to another arbitration provider.

 

Payment of all filing, administration and arbitrator fees will be governed by the AAA’s applicable rules.  If awarded fees That's Right Bitches, LLC will reimburse those fees in an amount up to $10,000. That's Right Bitches, LLC does not waive its own right to seek ALL attorneys’ fees and costs in arbitration.

 

You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in Los Angeles County or at another mutually agreed location.

Waiver of Right to Bring Class Actions and Representative Claims

All arbitrations shall proceed on an individual basis. The arbitrator is empowered to resolve the Dispute with the same remedies available in court, however, any relief must be individualized to you and shall not affect any other customer.

 

You and That's Right Bitches agree that each may bring claims against the other in arbitration only in your or their respective individual capacities and in so doing you and That's Right Bitches, LLC hereby waive the right to a trial by jury, to assert or participate in a class action lawsuit or class action arbitration (either as a named-plaintiff or class member), and to assert or participate in any joint or consolidated lawsuit or joint or consolidated arbitration of any kind. If a court decides that applicable law precludes enforcement of any of this paragraph’s limitations as to a particular cause of action, then that cause of action (and only that cause of action) must remain in court and be severed from any arbitration.

Other Terms

This Arbitration Agreement shall be governed by, and interpreted, construed, and enforced in accordance with the Federal Arbitration Act and, where applicable, the law of the Commonwealth of California. The terms of the Arbitration Agreement provisions shall survive after your relationship with That's Right Bitches, LLC and/or use of our websites or other services and products ends. Except as set forth above, if any portion of this Arbitration Agreement is deemed invalid or unenforceable, it will not invalidate the remaining portions of the Arbitration Agreement.
